These Terms of Use ("Terms") govern access to and use of the website at https://bourseforum.com (the "Site"). Accessing and using the Site is conditional on full acceptance of these Terms.

Article 1. Definitions

  • Terms: these Terms of Use.
  • User Content: all information posted by a User on the Forum.
  • Publisher: the entity responsible for the Site.
  • Forum: the discussion spaces provided on the Site.
  • Service: all features provided via the Site.
  • User: any individual accessing the Site and/or using the Service.

Article 2. Purpose

The Terms define how the Service is provided and used. The Service allows reading and participating in discussions on financial topics (stocks, ETFs, crypto-assets, real estate, financial tools).

Article 3. Acceptance and changes

3.1. Any User is deemed to have accepted the Terms simply by connecting to the Site.

3.2. The Publisher may modify the Terms at any time. Continued use of the Site constitutes acceptance of the changes.

Article 4. Access to the Service

4.1. The Service is free. Internet access costs are borne by the User.

4.2. Posting is possible without creating an account. The User acts under their sole responsibility.

4.3. The Publisher has no obligation of result regarding availability.

4.4. The Publisher may interrupt or modify access without notice.

Article 5. User obligations

5.1. The User is solely responsible for the content they post.

5.2. The following content is prohibited:

  • contrary to public order and morality;
  • insulting, defamatory, racist, xenophobic;
  • inciting discrimination or hatred;
  • threatening a person or group;
  • pedophile or pornographic in nature;
  • inciting a crime, offense, or act of terrorism;
  • inciting suicide;
  • constituting market manipulation or dissemination of false information on financial instruments;
  • infringing intellectual property rights;
  • infringing privacy;
  • for advertising or spamming purposes;
  • containing viruses or malicious code;
  • constituting identity theft.

5.3. The User agrees to be courteous to other Users.

Article 6. Moderation and reporting

6.1. A posteriori moderation. The Publisher may remove non-compliant content.

6.2. The Publisher is not subject to a general obligation to monitor.

6.3. Any User may report illicit content via the Site or by e-mail, under the conditions of French law n° 2004-575 of 21 June 2004.

6.4. IP banning is possible for serious or repeated breaches.

6.5. The Publisher cooperates with competent authorities.

Article 7. User Content and license

7.1. The User warrants that they hold all rights to the content they post.

7.2. The User grants the Publisher a non-exclusive, free, worldwide license for the legal duration of protection.

7.3. This license covers hosting, reproduction, distribution and archiving of the content via the Site.

7.4. User Content is public and accessible to third parties via the internet.

Article 8. No investment advice

WARNING — Forum content does not constitute investment advice, a recommendation, a solicitation, or a regulated investment service.

8.2. The Publisher is not a financial investment advisor.

8.3. Any investment involves risk of capital loss, which may be total.

8.4. The User remains solely responsible for their decisions.

8.5. The Publisher does not guarantee the accuracy or completeness of content.

Article 9. Intellectual property

9.1. The structure of the Site and its elements (excluding User Content) are the exclusive property of the Publisher.

9.2. User Content remains the property of its authors.

Article 10. Liability

10.1. The Publisher acts as a hosting provider under French law n° 2004-575 of 21 June 2004.

10.2. The Publisher is not liable for direct or indirect damages resulting from use of the Site.

10.3. The Publisher is not liable in case of Site unavailability.

Article 13. Term and termination

Indefinite duration. The Publisher may suspend access to the Service in case of breach.

Article 14. Survival

Articles 7, 8, 9, 10, 16 and 18 survive termination of the Terms.

Article 16. Miscellaneous

16.1. Force majeure. Force majeure events are exonerating.

16.2. Severability. Partial invalidity does not affect other clauses.

16.3. Assignment. The Publisher may assign its rights.

16.4. No waiver. Tolerance does not amount to waiver.

Article 17. Applicable law and jurisdiction

17.1. French law applies.

17.2. Amicable resolution is preferred.

17.3. Failing that, French courts have jurisdiction. Consumers may bring action before the court of their domicile.

Article 18. Entire agreement

These Terms constitute the entire agreement between the User and the Publisher.
